By enrolling in the Ekat’s Club membership, you agree to be bound by these Terms and Conditions.

 

Course Content

The membership content is a collection of educational materials created by Ekat’s Club for your personal learning and development.

You agree not to copy, reproduce, redistribute, share, resell, publish, transmit or otherwise make the membership content available to others, in whole or in part, without our express written consent.

Account Use and Login Sharing

Your membership is for individual use only.

Membership access is provided to one person only and sharing your account, login details or membership content with another person is not permitted.

You are responsible for maintaining the security of your account and login information.

Membership Enrollment and Payment

To join Ekat’s Club, you must complete the registration process and pay the applicable subscription fee shown on the checkout page.

Payments may be processed in USD, AUD or EUR. We accept major credit and debit cards. Additional payment options may be available at checkout.

By completing your purchase, you authorise Ekat’s Club and its payment providers to charge your selected payment method for the subscription plan you have chosen, including recurring renewal payments, until your subscription is cancelled.

 

Membership Pricing and Currency

The membership prices shown in USD, AUD and EUR are fixed amounts set by Ekat’s Club.

These prices are not based on daily exchange rates and are not calculated using real-time currency conversion.

Your card provider, bank or payment provider may apply its own exchange rate, foreign transaction fee, international transaction fee or other processing fee depending on your location and the currency you select.

Any such fees are charged by your provider and not by Ekat’s Club.

 

Subscription Billing and Renewal

Ekat’s Club is a recurring subscription membership.

You will be billed monthly or yearly depending on the membership plan selected at checkout.

Your first payment is charged immediately when you join. Your subscription will then automatically renew on a recurring basis on or around the corresponding billing date each month or year, depending on your plan, until cancelled.

By purchasing a membership, you acknowledge and agree that your subscription will automatically renew and that the applicable recurring membership fee may be charged to your selected payment method without requiring you to manually approve each renewal transaction.

 

Billing Issues and Payment Disputes

If you have a question, concern or believe there has been an error relating to a membership payment, renewal or cancellation, we strongly encourage you to contact Ekat’s Club at club@ekats.com.au before initiating a chargeback or payment dispute.

We will make reasonable efforts to investigate genuine billing concerns and resolve them directly where appropriate.

Ekat’s Club maintains records relating to membership accounts for legitimate business, administration, security and payment purposes. These records may include, where applicable:

• Subscription and order information
• Payment and renewal records
• Dates of account logins or sign-ins
• Course and membership content accessed
• Account activity and usage history
• Communications between you and Ekat’s Club
• Emails or support requests
• Cancellation or refund requests
• Membership and support history
• Acceptance of applicable checkout terms and policies

If a payment is disputed, challenged or charged back, Ekat’s Club reserves the right to respond to that dispute and provide relevant evidence to our payment processor, acquiring bank, card network, financial institution, issuing bank or other party responsible for reviewing the dispute.

Where Ekat’s Club reasonably believes a chargeback or payment dispute has been submitted incorrectly, improperly or despite authorised use of the membership, we may challenge the dispute using relevant membership, payment, account activity, correspondence, login, course access and support records.

Nothing in this section prevents you from exercising any rights you may have under applicable consumer protection laws or through your bank or payment provider.

 

Cancellation, Pausing and Access

There is no long-term contract beyond the billing period you have selected.

You may cancel your subscription at any time.

Pausing memberships is not currently available. You may cancel your membership and rejoin at a later date at the membership price available at that time.

Unless otherwise stated, cancellation prevents future renewal payments and does not cancel or reverse payments that have already been processed.

Your membership access will generally remain available until the end of your current paid billing period. After that date, your access will end unless you renew or rejoin.

 

Introductory and Special Pricing

If you join Ekat’s Club during an introductory, promotional or special pricing period, that price will remain available only while the qualifying membership remains continuously active, unless otherwise stated at the time of purchase.

If you cancel or unsubscribe, the introductory or special price will no longer apply.

If you rejoin in the future, you will be charged the membership price available at the time you rejoin.

Introductory or special pricing cannot be reinstated following cancellation unless Ekat’s Club expressly agrees otherwise.

 

Failed Payments and Access

If a payment attempt fails, Ekat’s Club or its payment providers may automatically retry the payment using the payment method associated with your account.

If payment remains unsuccessful, your membership may be suspended and access to membership content may be restricted until payment is successfully processed.

If payment is not successfully completed within a reasonable period, your subscription may be automatically cancelled and your membership access will end.

You are responsible for keeping your payment information accurate and up to date to avoid interruption to your membership.

 

Plan Changes

You may switch your membership plan through your account settings where this functionality is available.

Plan changes are subject to the membership plans, pricing and options available at the time the change is made.

 

Refund Policy

Subject to any rights you may have under applicable consumer law, membership payments are generally non-refundable.

Ekat’s Club provides immediate access to digital membership content following purchase. Refunds are therefore not ordinarily provided for subscription payments, unused membership periods, partial billing periods, change of mind or a failure to use the membership.

Cancelling your membership stops future renewals but does not automatically refund payments that have already been processed.

Yearly memberships automatically renew each year unless cancelled before the renewal date.

If you are charged for an annual renewal because you did not cancel before the renewal date, you may contact us to request a refund of that renewal payment only if your membership is cancelled and the refund request is submitted within one (1) day of the renewal charge.

Any refund approved under this annual renewal exception may be reduced by non-refundable payment processing costs or other transaction charges incurred by Ekat’s Club in connection with that payment, to the extent permitted by applicable law.

Nothing in this Refund Policy excludes, restricts or modifies any consumer guarantee, refund right or other legal right that cannot lawfully be excluded.

 

Content Availability and Changes

Ekat’s Club is an ongoing subscription membership and does not provide lifetime access to the membership library.

Ekat’s Club may update, replace, reorganise, modify or remove courses, lessons, resources, features or other membership content from time to time.

We may also add new membership content or change how existing content is presented or organised.

Where practical, significant membership changes may be communicated to members.

 

Limitation of Liability

Ekat’s Club is committed to providing high-quality educational content and supporting the learning and development of its members.

However, to the maximum extent permitted by applicable law, Ekat’s Club will not be liable for indirect, incidental, special or consequential loss arising from participation in the membership, use of the membership content or reliance on information provided through Ekat’s Club.

Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.

If you experience a problem with your membership, payment, account or course access, or have any other concerns, please contact us at club@ekats.com.au.

We will make reasonable efforts to assist you and address genuine concerns on a case-by-case basis.

We encourage members to contact us directly regarding billing or membership concerns so that we have an opportunity to investigate and resolve the issue.

 

Modifications to These Terms

Ekat’s Club reserves the right to update or modify these Terms and Conditions from time to time.

Updated Terms will be made available through our website or membership platform.

Where required by applicable law, material changes will be communicated appropriately.

Your continued use of Ekat’s Club following the effective date of updated Terms constitutes acceptance of those updated Terms to the extent permitted by law.
